This Legal Notice sets out the information required by Article 10 of Spanish Law 34/2002 of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), and the conditions that govern access to and use of the website 3duploader.com (the “Website”).

2. Purpose of the Website

The Website is an online platform for the distribution of digital three-dimensional models intended for 3D printing, visualisation, rendering, engineering reference and similar uses. Through it we offer models for purchase and download, informative content, and, where enabled, the possibility for registered users to upload and publish their own models.

3. Acceptance and scope

Accessing the Website makes you a user of it and implies your full acceptance of this Legal Notice in the version published at the time of access. If you do not agree with it, please do not use the Website.

This Legal Notice is complemented by our Privacy Policy, our Cookie Policy and, for purchases and uploads, by our Terms and Conditions. Where a conflict arises, the Terms and Conditions prevail in respect of contractual matters.

4. Conditions of use

You undertake to use the Website in accordance with the law, good faith, public order and this Legal Notice. In particular, you must not:

  • Use the Website for unlawful purposes or in a way that harms the rights or interests of third parties.
  • Introduce or spread viruses, malicious code or any software capable of damaging the Website or the systems of its provider or its users.
  • Attempt to gain unauthorised access to any part of the Website, its servers, its file storage or the accounts of other users.
  • Use robots, scrapers, crawlers or similar automated means to extract content or files in a way that disrupts the normal operation of the service or circumvents access controls or download limits.
  • Remove, circumvent or alter any technical protection, watermark or attribution notice applied to the content.
  • Resell, redistribute or make available the downloaded files beyond what the applicable licence permits.

We may deny or withdraw access to the Website, without notice and without any right to compensation, to any user who breaches these conditions.

5. Intellectual and industrial property

By uploading content, the user represents that they hold all the rights required to do so and that the content does not infringe third-party rights. 5.2 Third-party trademarks

Where the name of a manufacturer, brand or product is used — for example in a model title, a description, a category or a filter — it is used solely descriptively, to identify the real-world object that a model depicts, and constitutes nominative fair use for identification purposes.

Such use does not imply any affiliation, association, sponsorship, endorsement, approval or partnership between 3DUploader Inc. and the trademark owners, nor that the models are official, licensed or authorised products of those manufacturers. If you are a rightholder and consider that a particular use exceeds what is lawful, please contact us at copyrights@3duploader.com and we will address it promptly.

6. Notice and takedown of infringing content

If you believe that content available on the Website infringes your intellectual property, industrial property or other rights, send a notice to copyrights@3duploader.com including:

  • Your identification and contact details, and, where you act on behalf of the rightholder, evidence of your authority to do so.
  • A sufficiently precise identification of the allegedly infringing content, including the URL of each item concerned.
  • An explanation of the right you hold and why you consider it infringed.
  • A statement that the information in the notice is accurate and complete, and that you make it in good faith.

On receiving a sufficiently substantiated notice, we will assess it diligently and, where appropriate, remove or disable access to the content, informing the user who uploaded it and giving them the opportunity to respond. We will inform you of our decision and of the redress available. We may suspend the accounts of users who repeatedly upload infringing content.

7. Disclaimer of liability

7.1 Availability of the Website

We take reasonable care to keep the Website available and free of errors, but we do not guarantee uninterrupted availability. We are not liable for interruptions, delays, errors or failures arising from causes beyond our reasonable control, including failures of the internet, of the hosting or content delivery providers, or of the user’s own equipment, nor for damage caused by malicious software or unlawful access by third parties, provided we have applied appropriate security measures.

7.2 Content and suitability of the models

The models offered are digital files supplied on an “as is” basis. We take care over the accuracy of descriptions, specifications and previews, but we do not warrant that any model is geometrically exact, dimensionally accurate, watertight, free of defects, or fit for any particular purpose.

The models are not certified engineering documentation. They must not be relied upon for structural calculation, certification, or the manufacture of parts intended for safety-critical, medical, aeronautical, automotive or load-bearing applications without independent verification by a qualified professional. You are solely responsible for validating any model before using it in manufacturing, and for the results of printing or producing it, including the settings, materials and equipment used.

7.3 Consumer rights

None of the disclaimers in this section limits the rights that consumer protection law grants you as a consumer, nor our liability for wilful misconduct or gross negligence, nor for death or personal injury caused by our negligence.

8. Links

Outbound links. The Website may contain links to third-party sites. We do not control them and are not responsible for their content, their availability, or the accuracy or lawfulness of what they offer. Their inclusion does not imply any endorsement. If you become aware that a linked site is unlawful, please tell us so that we can remove the link.

Inbound links. Linking to the Website is permitted provided the link points to the home page or to a specific public page, does not reproduce our content, does not create a frame around it, does not falsely suggest an association with us and does not accompany statements that damage our reputation. Linking does not grant any right over the Website or its contents.

9. Personal data

The processing of personal data through the Website is governed by our Privacy Policy and our Cookie Policy, which form part of this Legal Notice.

10. Modifications

We reserve the right to modify this Legal Notice, and the presentation, configuration and content of the Website, at any time and without prior notice. The version published on the Website at the time of access is the one that applies.

11. Severability

If any provision of this Legal Notice is declared invalid or unenforceable, that provision shall be removed or reinterpreted to the minimum extent necessary, and the remaining provisions shall remain in full force.

12. Applicable law and jurisdiction

This Legal Notice is governed by Spanish law.

For the resolution of any dispute arising from access to or use of the Website, the parties submit to the courts of Madrid, expressly waiving any other jurisdiction that may correspond to them.

Where the user acts as a consumer, this submission does not apply: the competent court will be the one determined by the applicable consumer protection rules, which as a general rule is that of the consumer’s place of residence.
